Welcome to SoundByte (also referred to as "GiphyByte", the "App", or the "Service"), owned and operated by DestinPQ ("we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of our App, custom keyboard extensions, iMessage extension, public website sharing pages, and related backend APIs. By downloading, installing, or using the Service, you agree to comply with and be legally bound by these Terms.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity. If you do not agree to these Terms, you must immediately cease all use of the Service and delete the App from your devices.
1. Eligibility and Account Registration
The Service is rated 4+ on App Stores and is intended for general audiences. By using the Service, you represent and warrant that you possess the legal capacity to enter into a binding agreement. You do not need to register a formal account to browse the standard meme gallery, but local profile stores on your device will track custom uploads. You are responsible for ensuring the security of your device and the content stored on it.
2. Privacy Policy Integration
Your privacy is paramount to us. Our collection and use of device resource permissions (such as microphone access for recording voice catchphrases and storage access for custom files) are governed by our Privacy Policy. By agreeing to these Terms, you also acknowledge and consent to the data practices described in our Privacy Policy.
3. Description of Service and Device Permissions
SoundByte provides a platform for browsing, playing, recording, and sharing custom soundbytes, gifs, and animated effects. To facilitate these features, the App requests permissions including:
- Microphone Permission (`RECORD_AUDIO`): Utilized solely to record voice samples and custom sound effects when you choose to create a custom meme.
- Network Access: Necessary to fetch public meme libraries, upload user-generated clips to our secure GridFS storage, and play shared sound bytes.
4. User-Generated Content (UGC)
You retain ownership of any custom audio recordings, video clips, or image files you upload, stream, or transmit through the Service.
- License Grant to Us: By uploading or recording content through the Service, you grant DestinPQ a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, cache, reproduce, transmit, and display your UGC solely for the purpose of operating, distributing, and improving the Service (such as rendering play pages and enabling keyboard pastes).
- Your Representation: You represent and warrant that you own all rights in your UGC or have obtained all necessary licenses, consents, and releases from rights holders, and that your UGC does not violate the intellectual property, privacy, or publicity rights of any third party.
- Content Monitoring and Takedown: We do not pre-screen all UGC. However, we reserve the right, in our sole discretion, to remove or disable access to any UGC that violates these Terms, is reported by other users, or is deemed objectionable or illegal.
5. Intellectual Property Rights of DestinPQ
Except for your UGC, all materials, software, designs, logos, graphics, icons, preloaded audio assets, and the "look and feel" of the Service are the exclusive intellectual property of DestinPQ and its licensors. You are granted a limited, personal, non-exclusive, non-transferable, revocable license to access and use the App for non-commercial entertainment purposes.
6. Prohibited User Conduct
You agree not to engage in any of the following prohibited activities while using the Service:
- Infringement: Uploading or sharing copyrighted audio, video, or image tracks without permission from the legal owner.
- Abuse and Harassment: Uploading custom recordings that contain hate speech, threats, harassment, vulgarity, or pornographic material.
- Security Interference: Discarding, disabling, or interfering with security-related features, or uploading files containing viruses, Trojan horses, or malicious scripts.
- System Abuse: Sending automated queries, scraping the backend database, or overloading our hosting servers.
7. DMCA Copyright Infringement Policy
If you believe that any content hosted on our Service infringes upon your copyright, you may submit a written notification pursuant to the Digital Millennium Copyright Act (DMCA) to our designated agent at [email protected]. Your notice must include:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the infringing material and its specific URL or database location.
- Your contact information (address, telephone number, and email).
- A statement that you have a good faith belief that use of the material is not authorized.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, DESTINPQ DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR FREE OF ERRORS, VIRUSES, OR BUGS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DESTINPQ, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE, REGARDLESS OF THE LEGAL THEORY.
10. Term and Termination
These Terms remain in effect until terminated by either you or us. You may terminate these Terms by deleting the App and all copies from your device. We reserve the right to suspend or terminate your access to the Service at any time, without notice, if we believe you have violated these Terms.
